  • Asylum is a legal status used in the U.S. immigration laws, and is form a protection which allows an individual to remain in the U.S instead of being removed(deported) back to a country where he or she fears persecution or harm.

    Not everyone qualifies for asylum in the U.S. , to qualify you must be in the United States and believe you will be in the danger of persecution or have fear of persecution in you home country due to your Race, Religion, Nationality, Social group or Political opinion.

  • This process is for individuals who are not in removal proceedings. This processing involves your physical presence in the United States.

    You have to apply within one year of your latest U.S. arrival unless you can prove extraordinary circumstances. To apply through this process you must submit a Form I-589, called Application for Asylum and Withholding of Removal with USCIS.

    If you your application is denied or found ineligible, you can still remain in the United States, while your application is pending with an Immigration Judge which will turn into a Defensive Asylum.

  • This process applies to individuals who are non-citizens and are undergoing removal proceedings with the EOIR (Executive Office for Immigration Review).

    Individuals are referred to as defensive asylum in one of the following ways:

    1. Your affirmative asylum application was referred to an immigration judge after the USCIS officer declare ineligibility for asylum .

    2. The individual is under removal proceedings because of the following:

      1. They were stopped at the U.S port of entry without legal documentation.

      2. The department of Homeland Security(DHS) started the removal proceeding , DHS served the noncitizen with a Notice to Appear(NTA) to begin the removal process.
